Presenter: Stephen Phillips
Based on decades of experience in representing roofing contractors, NRCA Counsel Stephen Phillips will present a program identifying and describing major risks that pose substantial liability exposures to roofing contractors and offer specific recommendations that roofing contractors can and should take to minimize those risks and reduce liability exposure. The program would include discussion of risks pertaining to roof performance, deck conditions, emissions from roofing products, personal liability arising from performance bonds, attachment of roof materials, wind uplift testing, indemnification obligations, risk of loss prior to project completion and inadequate insurance. Using contract provisions and insurance to reduce liability exposure will be discussed in detail. This presentation is geared toward Commercial Roofing Contractors and is for firms of all sizes. It is presented at all levels, although it will be particularly useful for intermediate and advanced and medium and large roofing contractors. 1. Alert roofing contractors to risks that arise in roofing contracts and construction that pose substantial liability exposure to them. 2. Provide roofing contractors with specific recommendations of steps and actions they can and should take to minimize liability exposure and what insurance should be maintained. 3. Demonstrate how contract provision can be used either to increase or reduce risk and liability exposure. 4. Inform roofing contractors of technical problems that have led to lawsuits and large claims. Legal/HR.
